Tier 1 Entrepreneur Extension

The following information is given in order to provide you with a generalised overview of the criteria required for the Tier 1 (Entrepreneur) extension application. In order to apply for an extension under this category:

1. The migrant must have invested, or had invested on his/her behalf, not less than £200,000 (or £50,000 if, in his/her last grant of leave, he/she was awarded points for funds of £50,000 from: one or more venture capital firms regulated by the Financial Services Authority; one or more UK entrepreneurial seed funding competitions listed as endorsed on the UK Trade & Investment website; or one or more UK Government Departments, and made available by the Department(s) for the specific purpose of establishing or expanding a UK business; in cash directly into one or more businesses in the UK; and,

2. The migrant has:
  • registered with HM Revenue & Customs as self-employed; or
  • registered a new business in which he is a director; or
  • registered as a director of an existing business.
Where the migrants last grant of entry clearance, leave to enter or leave to remain was as a Tier 1 (Entrepreneur) migrant, one of the points in point 2 must have been met within six months of the specific date.

3. The migrant is engaged in business activity at the time of his/her application to extend their permission to stay and provides the specified evidence to show that on a date no earlier than three months prior to the date of application, the applicant was:
  • registered with HM Revenue and Customs as self-employed, or
  • registered a new business in which he is a director, or
  • registered as a director of an existing business.
4. The applicant has:
  • established a new business or businesses that has/have created the equivalent of at least two new full-time jobs for persons settled in the United Kingdom; OR
  • taken over or invested in an existing business or businesses and his/her services or investment have resulted in a net increase in the employment provided by the business or businesses for persons settled in the UK by creating the equivalent of at least two new full time jobs for persons settled in the UK.
Where the migrants last grant of entry clearance or leave was as a Tier 1 (Entrepreneur) migrant, the jobs must have existed for at least 12 months for the period for which the previous leave was granted.
  • English language - Evidence to prove that the migrant speaks English to the required standard.
  • Maintenance: - A certain amount of funds to support the migrant in the United Kingdom.
